    Hi Bazza,

    I have a thread that you were helping with in a case of Unenforcable agreement. It went dormant for a while whilst a test case went through. I have now had a Directions hearing date for next week (25th March) but also a pack from Howard Cohen solicitors which includes a poor photocopy of my old credit agreement from 1993 and also two pages from an agreement but on the bottom of the pages the year is 2008...!!

    If you have the time could you look at my posting number 192. I am unsure of whether or not this agreement is now enforceable as I do not know what to look for. My main defence was that they did not reply to my CPR request...

    Hi Bazza
    Your advice to others has been very helpful with our battle against Westcot. In October we requested a copy of the CCA relating to a loan they claim my partner defaulted on. IWe sent the cheque for 1 but then got a letter asking Stuart to provide his last 3 addresses as proof of identuty that they neeed before they send the CCA. We used the advice you gave to someone last year and wrote to Westcot saying this is not an acceptable way of proving Stuart's identity but did enclose photocopy of his driving license. Today Stuart received a letter with the 1 cheque enclosed saying that they can not provide a copy of the CCA because Stuart will not confirm his last 3 addresses. I do not believe that Westcot or Natwest have such a CCA and that's the real reason they can't provide it so do you think we should continue trying to get a copy of the non exsistant CCA so they have to drop it or just see what happens?
