    Hi Stephen
    I am having a little trouble posting in the right place. I do have a thread in Halifax credit cards but I did notice that when I ask a question in my thread, it doesn't show up as a new post for answering in the 'new posts' section. I last posted on 18/4 and haven't had a reply yet. Am I doing this correctly? Thanks Sindbad

    Good evening Stephen

    Quick question regarding CCA 1974 (as amended). You state that the amendment to CCA1974 where s.140 was replaced with s.140A and s.140B means that it cannot apply to charges levied before (April?) 2006, in other words the current act is not retrospective.

    Does this mean;
    1. That I can't claim my charges back from before 2006
    2. I can use the Act's contents before it was amended covering the period of my claim (1996-2001)
    3. Does this current Act still apply to my claim period?

    had a letter from bank of scotland on 13.01.10 basically telling me that they wont be upholding my complaint or be providing a refund
    if we dont hear in 8 weeks we will close your complaint.

  9. Dear Stephen,

    Thank you for recently sending me your e-mail, which had links to the BRAND NEW Defence against strike out application, which was available to download in Portable Document Format (PDF)/Word Document format.

    Fortunately for me, I previously received adequate compensation from my bank in respect of penalty charges, as my claim was issued at the local County Court well before the bank charges claims by members were stayed by the Supreme Court due to the recent Office Of Fair Trading Test Case.

    My bank decided to settle out of court, and then approximately three weeks later the remaining claims were stayed. That was fortuitous I must admit!
