View Full Version : Preparing a Credit Agreement Court Bundle

Hi Good People

Please your help is needed. I intend to file county court (http://www.consumeractiongroup.co.uk/forum/autolink.php?id=2&forumid=170&script=showthread) cases in respect of few credit agreements that were either unsigned or not existing at all. I need somebody's copy of similar cases that was lodged in court or any template of the grounds, statutory sections and cases to support my claim against the creditors/lenders. I have read a lot of people's postings and seen few bundles, but most are for bank charges (http://www.penaltychargesforum.co.uk/forum/), I need a template skeletal arguement for unenforceable credit agreement which set out these grounds, including unfair relationship, irresponsible lending, unsigned and illegible agreements, etc. I am sorry if this is too much a request, just don't know how to set it out, I have all the Subject Access Request (http://www.consumerforums.com/resources/templates-library/48-bank-templates/110--data-protection-act-1998-subject-access-request)'s and the lenders have started referring the cases to DCA (http://www.consumerforums.com/resources/templates-library/86-debt-collectors.html) and CRA (http://www.consumeractiongroup.co.uk/forum/autolink.php?id=7&forumid=170&script=showthread), so I need to stop/suspend this actions by court claims.

What are you filing at court for?

Are you seeking to get the accounts declared void or to reclaim the charges?

My advise here is NOT to take them to court but to wait for the Creditor to take you to court

That way, they have to proove the case and you can defend

If you take them to court, you have to prove and they defend and that can be prone to more difficulties

Anyway, if your agreements are not correctly executed then it is less likely that they will go to court

Always put the ball in ther court and let them do the running
