Hi, Have been browsing the forums for hours now but still cant get my head around where to go for some helpfull advice on urgent matters.

Basically I had started a claim from Barclays in may, followed the guidelines, right through to having sent the letter before initiating court proceedings. I had a reply about the test case, stating no more claims will be looked at by the courts until further notice.

At that point, I was on a low anyway + lost all hope of ever getting any of the money back from which had been the cause of serious money problems inc swallowing my benefits the second they touched my account.

I am now in serious debt, mainly caused by Barclays STILL charging me £30 twice on somedays for "paid referral fees" on unpaid items which should have been ok to pay, had my bank not taken out their £30 fees over + over taking me well over my agreed OD limit (I did not know this was happening until I checked online 2 wks later - no letter was sent warning me I was getting charges!!)

How can they still be allowed to do this?? Its obvious that the charges are causing my account to spiral downhill FAST!!

Any advice would be most appreciated, as xmas is near + I dont even have the £ to top up my elec meter let alone buy presents for my 4yr old daughter :-(

hello,
first, have you sent the LBA ?
what date was it sent ?
have you filed your claim in court ?
if you have, are you on benefit ?
if so the banks are not supposed to levy any charges whilst the court cases are on hold. in fact if you are in financial hardship you may get your case to court anyway.
who told you that no more cases would be looked at ?
the court ?
or the bank ?
only take notice of what a court may tell you !
a bank will tell you that info to put you off and try to delay your action.
give us dates etc,. of what action you have taken so far....

the first thing you need to do i get another b/acc
all banks MUST provide you whith an acc upon request
even a basic card acc
then get all funds and bens paid into the new acc
do this IMEIEDIATELY!!!!!

Thanks for your replies.
here are the dates. (I also filed a complaint with the information commissioner, who replied that due to the number of complaints, they are not dealing with each individually or immediately, but will be contacting Barclays bank at the end of the month with the total complaints received from the previous month)

20/2/07 - DPA disclosure request inc. £10 PO sent (recorded) got no reply
5/4/07 - DPA disclosure request reminder (special delivery) I then got my statements through.
21/8/07 - LBA requesting all charges be refunded within 14 days, if not I will start legal proceedings.

28/8/07 Received a letter from Barclays stating my complaint / claim has been filed + will be looked at once the legal proceeding between the OFT and banks finish....which may take over a year......

I had contacted the bank saying I had been advised that i should continue to enter a claim at the court, they agreed but said I would have to pay the court costs upfront, but that the case would still not be heard until the test case is finished, if the banks won I would not get a refund from the court
I didn't have that money to spare at that time to hand over + risk losing it for nothing, so I didnt take it any further.

Right I have had a read.

I am assuming that you are in receipt of benifits only, if so you will not have to pay any court fees at all. You will need to complete a form EX160 and bring along proof that you are on benifits. If you are working and are also in receipt of any benifits then as long as you can show to the court manager at the time of filing the court your finaincial hardship they will waiver the court fee on you producing proof of this, (your bank statements will do this as the court cannot take any money from you if it is likely to increase your debts or palce you or another that you support into hardship or further hardship)

All you need to do is complete the N1 form using the benifit POC, complete a scehdule of charges and attach your letters to and from the bank regarding this matter.

Then create three copies from the originals and submit this to the court along with a EX160 which you can get at the court and complete there and then. To complete this there is an income and expendature part within, that shows how much your pay out on things etc and will give an end balance of what is available at the end. From reading your posts earlier this would appear to nothing.

Also I would open a new basic account at another bank and have any wages or benifits paided into this and change your DD's over once you know that your wages/benifits are being paid into it.

Then sit back and wait.
