View Full Version : Barclay complaints leaflet want another 2 weeks?

Hi, i got my statements did the sums and arrived at £450.00 (im on benefits so its a huge amount to me) i sent off the 14 day letter, the 14 days are up today and i got a letter and a leaflet the leaflet heading is "Dont hold back, what to do if you want to complain" the letter says they are looking into my concerns and will let me have an answer or update not later than the 29th march.... Is this another delaying tactic? should i wait untill the 29th or should i go ahead an make my court claim as the 14 days finish today?

I sent this letter after receiving the same thing :
Thank for your letter ref:xxxxxxxxx (**/**/ 2007)
I must state that I am not making a complaint. I am requesting a full refund of the bank charges that have been levied upon me, charges that are contrary to the Unfair Terms in Consumer Contracts Regulations 1999. Schedule 2 (e) of the said regulations which gives a non-complete list of terms, which may be regarded as unfair, such as a term that requires me as a consumer who fails in his obligation, to pay a disproportionately high sum in compensation.
This does not take **** weeks to investigate, therefore as a gesture of good will, I am prepared to give you an extra seven days from my original request to refund all of my bank charges dating back six years. This letter was recieved by yourselves by recorded delivery on the *th of ****** 2007. This gives us a new date of the *** of **** 2007. These bank charges are a disproportionate penalty and therefore unenforceable as they are contrary to common law. Due to this I will be making no further contact until I have a full refund of the said charges. If this is not achieved by this date I have no other option than to issue a court order.

Hi,
I am in the same position, I am owed 3,485 pounds in bank charges and I have just incurred another 100 on top (can I add these to my claim)
I sent barclays 14 day letter on the 26 Febuary and received the standard sorry your unhappy with our service letter dated the 8 March, They are looking into the matter and will give me an answer no later than the 27th March( the 14 days were up from date of letter 12th March) Obviously they want to delay, I am on benefits and in the exact amount of debt that I am owed so this is life changing for me.
Should I just continue with the courts or send the letter you suggested above.
I need this to be resolved ASAP as they are still charging my account as direct debits have gone unpaid and so on.
What should be My next step, I'm currently waiting for the benefit agency to send me a letter of proof, which can take up to ten days.
would be really grateful for any advice.

You can create a new thread in the relevant section in the forum for your bank called soon to be debt free v <bank>. Keeping this up to date will help us to advise you along the way.
But to answer your question - when you are ready to file your court claim you can bring it right up to date with any new charges that appear on your statement.
